The South American giant takes a huge step - El gigante sudamericano da un enorme paso
The Chamber of Deputies of Brazil, the largest economy in Latin America, this Tuesday, 11/29/2022, has just approved a law that regulates the cryptocurrency sector in the country. The project had already been approved in the middle of the year, but it returned to the Lower House after the text underwent changes during a vote in the Senate.
Now the executive power must sanction it and the law will enter into force 180 days after the signature of the president of the republic.
As can be seen from the text of its main article, as of the entry into force of the law, cryptocurrencies are considered a digital representation of value that can be traded or transferred by electronic means and used to make payments or for investment purposes. This means that both bitcoin and other cryptocurrencies are simply recognized as means of payment and investment.
The law also includes a text that typifies a new figure of fraud that will be added to the current penal code that is directly related to virtual assets, their commercialization, exchange, and investment.
The measure is not surprising but was strongly promoted during the Bolsonaro government as an action to demonstrate Brazil's interest in taking concrete actions towards greater integration into the Organization for Trade and Economic Development (OECD), a global project which brings together more than 30 countries and whose main motto is "better policies for a better life".
Great news for the crypto ecosystem that was desperately needing something like this to at least somewhat shake the bull that has it trapped.
La cámara de diputados de Brasil, primera economía de América Latina este martes 29/11/2022 acaba de aprobar una ley que regula el sector de las criptomonedas en el país. El proyecto ya había sido aprobado a mediados de año, pero volvió a la Cámara Baja luego de que el texto sufriera cambios durante una votación en el Senado.
Ahora el poder ejecutivo debe sancionarla y la ley entrará en vigencia 180 días después de la firma del presidente de la república.
Según se desprende del texto de su principal artículo, a partir de la entrada en vigencia de la ley criptomonedas se consideran representación digital de valor que puede negociarse o transferirse por medios electrónicos y usarse para realizar pagos o con fines de inversión. Esto quiere decir que tanto bitcoin como otras criptomonedas son reconocidas lisa y llanamente como medios de pago e inversión.
La ley también incluye un texto que tipifica una nueva figura de fraude que se añadirá al código penal vigente que está relacionado directamente con los activos virtuales, su comercialización, intercambio e inversión.
La medida no es sorpresiva sino que fue fuertemente impulsada durante el gobierno de Bolsonaro como una acción tendiente a demostrar el interés de Brasil en tomar acciones concretas hacia una mayor integración en la Organización para el Comercio y el Desarrollo Económico (OCDE), un proyecto mundial que nuclea más de 30 países y cuyo lema principal es “mejores políticas para una vida mejor”.
Una gran noticia para el ecosistema criptográfico que estaba necesitando desesperadamente algo como esto para sacudir al menos en algo al toro que lo tiene atrapado.
